Terms of Use
Article 1 (Definitions) Nihon Insights refers to the bespoke travel planning, tour coordination, and cultural experience facilitation services offered by Nihon Insights GK (hereinafter referred to as the “Company”). The customer (hereinafter referred to as the “Customer”) is defined as any individual, organization, or entity who agrees to these Terms of Service and registers for or uses any Service provided by the Company.
Article 2 (Provision of Services) The Company provides custom and package travel planning, guide coordination, cultural reservations, logistical arrangements, and experience curation throughout Japan. The Company may also share cultural content and recommendations via email or online platforms. The Company reserves the right to include advertising or partner-related content in such communications.
Article 3 (Changes to Service Content) The Company may, without prior notice, change, suspend, or terminate any part of the Service. In the case of major changes, the Company will provide reasonable notice via email, website, or other means.
Article 4 (Prohibited Acts) Customers may not engage in any of the following:
- Providing false or misleading personal or booking information
- Violating laws, regulations, or public order
- Infringing on intellectual property rights or privacy
- Defaming, harassing, or harming other parties
- Impersonating others or unauthorized access to the system
- Posting or sending viruses or malicious data
- Reselling, transferring, or sharing login information
- Soliciting unrelated services or organizations
- Directly transacting with suppliers introduced via the Company without Company consent
- Using confidential information acquired through the Service for unrelated purposes The Company reserves the right to suspend or terminate Services if any of the above are violated.
Article 5 (Customer Information Usage) Customer information is used for:
- Booking, service coordination, and communication
- Authentication and profile management
- Delivery of updates, offers, or important notifications
- Internal research, feedback collection, and statistical analysis
- Promotional use (with anonymization and/or consent)
Article 6 (Correction or Removal of Personal Data) Customers may request the disclosure, correction, or deletion of their personal information. The Company will verify the identity of the requester before responding to such requests.
Article 7 (Liability Disclaimer) The Company is not responsible for damages incurred through:
- Changes, delays, or cancellations beyond its control
- Third-party performance or conduct
- Customer dissatisfaction with experiences or guides
- Service interruptions, data loss, or errors The Company’s liability is limited to direct, ordinary damages, and excludes loss of opportunity or indirect damages.
Article 8 (Force Majeure and External Risks) The Company bears no responsibility for losses due to natural disasters, pandemics, governmental actions, transportation strikes, or technical failures. Customers are encouraged to secure personal travel insurance.
Article 9 (Changes to Terms) These Terms may be amended at any time without prior customer approval. Updates will be considered effective upon publication on the Company’s website or notification by email.
Article 10 (Governing Law and Jurisdiction) These Terms shall be governed by the laws of Japan. Any disputes shall fall under the exclusive jurisdiction of the Kyoto District Court.
Article 11 (Business Hours) Company business hours are Monday to Friday, 10:00 a.m. to 6:00 p.m. (JST). Inquiries received outside these hours will be processed the following business day.
Personal Information Handling
- Definition Personal Information includes names, email addresses, phone numbers, and other data that can identify a Customer individually or in combination with other information.
- Purpose of Use
- Tour coordination, reservations, and communications
- Providing updates or relevant offers
- Survey and campaign participation
- Responding to customer inquiries or issues
- System operations and backups
- Disclosure to Third Parties The Company does not disclose personal information without consent, except:
- Where legally required
- In emergency situations involving safety or criminal investigation
- Upon business transfer or merger involving the Company
- Data Security and Retention The Company implements appropriate safety and access control measures. Data is stored securely and reviewed regularly to prevent unauthorized access, loss, or misuse.
- Subcontracting If handling of personal data is subcontracted, it is done under strict confidentiality and oversight to vendors that meet Company privacy standards.
- Compliance The Company complies with all applicable Japanese laws and privacy regulations.
