General Participation Waiver

This waiver applies to all activities and experiences organized by Nihon Insights GK (“Nihon Insights”), including but not limited to cultural workshops, artisan experiences, culinary programs, and other curated events. By signing this document, checking the agreement box during booking, or participating in any activity provided or introduced by Nihon Insights, you agree to the terms outlined below. This waiver is intended to comply with the laws and regulations of Japan.

  1. Voluntary Participation and Acknowledgment of Risk

I understand and agree that I am participating in the selected activities of my own free will. I acknowledge that many of these activities take place in environments that may involve inherent risks, including but not limited to the use of tools, heat, sharp objects, physical movement, interaction with third parties, or participation in natural settings. I accept full responsibility for any harm that may arise from risks not caused by the negligence of Nihon Insights.

  1. Safety Compliance

I agree to follow all safety instructions and behavioral rules provided by Nihon Insights staff, contractors, or any third-party experience providers. I understand that failure to comply may result in removal from the activity without refund. I accept that if I disregard safety instructions or behave recklessly, I may be personally responsible for the resulting consequences.

  1. Limitation of Liability

Nihon Insights carefully selects and coordinates experiences in collaboration with trusted local partners. While each experience is operated by the provider themselves, Nihon Insights remains involved in the planning and communication process to ensure a high standard of service. However, responsibility for the on-site execution lies with the provider, and Nihon Insights is not liable for incidents, injuries, or losses arising during the activity unless due to negligence in our coordination or communication.

  1. Responsibility for Damages

I agree to compensate Nihon Insights or relevant third-party providers for any damage to equipment, tools, or facilities caused by my own intentional or negligent actions. I understand that minor accidental damages may occur, and I will be held accountable in accordance with their nature.

  1. Third-Party Providers and Referrals

I understand that some activities may be provided by independent third parties. If Nihon Insights refers me to such providers, I agree that my contract will be directly with the third party. I acknowledge that Nihon Insights is not responsible for any injury, loss, or dispute arising after the introduction. Any fee charged by Nihon Insights in such cases is strictly for coordination, communication, or referral and does not constitute acting on behalf of the client.

  1. Emergency and Data Disclosure

In the event of an emergency, I understand that the information provided on my registration form or this waiver may be disclosed to appropriate medical, insurance, or legal authorities as needed.

  1. Health and Alcohol Policy

I confirm that I am in adequate health to participate in the selected experience and will not do so while under the influence of alcohol or drugs. I understand that I may be excluded from participation if I appear unwell or fail to disclose relevant health conditions.

  1. Insurance and Personal Property

I understand that it is my responsibility to carry any necessary travel or medical insurance. Nihon Insights is not responsible for the loss, theft, or damage of personal belongings unless caused by the company’s negligence.

  1. Acknowledgment and Agreement

I confirm that I have read and understood this waiver in full. If I am not a native speaker of Japanese, I have either referred to the English reference version provided or taken independent steps to translate the legally binding Japanese version into my own language. I acknowledge that this waiver complies with Japanese law and is designed to inform me of the risks and responsibilities involved in the experience.

  1. Dietary Restrictions and Health Responsibilities

If Nihon Insights arranges or recommends a meal, tasting, or food-related experience, participants are required to proactively inform Nihon Insights in writing of any dietary restrictions, allergies, or medical conditions in advance. Participants also acknowledge their personal responsibility to understand their own health needs and limitations. This includes carrying any necessary emergency medication (e.g., EpiPen, antihistamines, insulin, etc.) during the activity. Nihon Insights does not provide medical supplies and is not liable for any reactions or health issues that arise from undisclosed or unmanaged dietary conditions.

参加同意書およびリスク承諾書

この同意書は、Nihon Insights GK（以下「Nihon Insights」）が主催するすべての活動や体験に適用されます。文化的なワークショップ、職人との交流体験、料理プログラム、その他のキュレーションされたイベントが含まれますが、これらに限定されません。本書への署名、予約時のチェックボックスによる同意、またはNihon Insightsが提供または紹介するいかなる活動への参加をもって、以下の条件に同意したものとみなされます。本同意書は、日本の法律および規制を順守することを目的としています。

1. 自発的な参加とリスクの認識

私は、選択された活動に自らの意思で参加することを理解し、同意します。これらの活動の多くは、道具の使用、熱源、鋭利な物、身体的な動作、第三者との交流、自然環境における体験など、内在するリスクを伴う可能性があることを認識します。Nihon Insightsの過失によらないリスクから生じた損害については、私自身が責任を負うことを受け入れます。

2. 安全遵守

私は、Nihon Insightsのスタッフ、契約者、または第三者提供者から提供されるすべての安全指示および行動ルールに従うことに同意します。安全指示を無視したり、軽率な行動を取った場合、返金なしで活動から除外される可能性があることを理解します。

3. 責任の限定

Nihon Insightsは、信頼できる地元パートナーと連携し、体験の企画および調整を丁寧に行っています。各体験の現場運営は提供者自身の責任で実施されますが、Nihon Insightsは企画段階や連絡調整に関与し、高品質なサービスが提供されるよう努めています。ただし、現地での事故、怪我、損失等については、当社の調整や連絡業務における過失がある場合を除き、責任を負いません。

4. 損害に関する責任

私は、自らの故意または過失によって発生した設備、道具、施設への損害について、Nihon Insightsまたは関係する第三者提供者に対して補償することに同意します。

5. 第三者提供者および紹介に関する事項

私は、一部の活動が独立した第三者によって提供される可能性があることを理解しています。Nihon Insightsが第三者提供者を紹介する場合、私はその提供者との契約が私自身と提供者の間で直接締結されることに同意します。紹介後に発生した怪我、損害、紛争について、Nihon Insightsは責任を負わないことを理解します。このような場合にNihon Insightsが請求する料金は、あくまでも連絡調整・紹介のためのものであり、クライアントを代理しての業務ではありません。

6. 緊急時および情報開示

緊急事態が発生した場合、私は登録フォームまたは本同意書に記載した情報が、必要に応じて医療機関、保険会社、行政機関などに開示される可能性があることを理解し、同意します。

7. 健康および飲酒に関するポリシー

私は、選択された体験に参加するのに適切な健康状態であることを確認し、アルコールや薬物の影響下では参加しないことに同意します。体調不良が明らかな場合や、健康状態を適切に申告しなかった場合には、参加をお断りする場合があることを理解します。

8. 保険および個人所有物の管理

旅行保険や医療保険に加入するのは私自身の責任であることを理解しています。Nihon Insightsは、自己の過失による場合を除き、個人所有物の紛失、盗難、破損について責任を負いません。

9. 同意の確認

私は、本同意書の内容をすべて読み、理解したことを確認します。日本語が母語でない場合、英語版の参考訳に目を通すか、自己の責任において翻訳を行ったことを確認します。本同意書が日本の法律に準拠しており、体験に関わるリスクと責任を明確にするために作成されていることを理解しています。

10. 食事制限および健康管理に関する責任

Nihon Insightsが食事を伴う体験を手配または推奨する場合、参加者は、アレルギーや疾患などの食事制限に関する情報を、事前に書面で必ずNihon Insightsに通知する義務があります。また、参加者は、自身の健康状態を理解し、必要な緊急用医薬品（例：エピペン、抗ヒスタミン薬、インスリンなど）を活動中に携帯する責任を負うことを認識します。Nihon Insightsは医薬品を提供せず、申告されていない、または参加者自身で管理されていない食事条件から生じる健康問題について責任を負いません。
